These Terms and Conditions outline the rules and regulations for the use of the Pretty's Prints website, located at https://www.prettysprints.com, and for the purchase and use of digital products, clipart, templates, printables, and other creative resources offered by Pretty's Prints through this website and any authorised sales channels.

By accessing this website, creating an account, downloading free materials, or purchasing a product, you agree to be bound by these Terms and Conditions. If you do not agree to all of the terms stated on this page, you must not use Pretty's Prints or purchase its products.

These Terms incorporate the Clipart Commercial Use Licence and the Personal Use Licence issued with Pretty's Prints products. Where a product listing specifies a particular licence, that licence governs your use of that product. If a conflict exists between a product-specific licence file included with your download and these Terms, the product-specific licence file controls for that product.

2. Definitions

“Pretty's Prints,” “we,” “us,” and “our” mean Pretty's Prints, operating the website prettysprints.com and related shops.

“You” and “your” mean the visitor, purchaser, or licensee.

“Artwork,” “clipart,” or “original files” mean the individual image files (including PNG, SVG, JPG, and similar formats) created by Pretty's Prints.

“Finished product” means a physical or digital item that you create by incorporating Pretty's Prints artwork as an element of your own original design or layout, rather than offering the original files themselves.

“Template” means a layout, planner, journal structure, Notion or similar workspace, printable system, or other structured file sold or offered by Pretty's Prints for you to customise and use, as distinct from standalone clipart files.

3. Cookies

The website uses cookies to help personalise your online experience. By accessing Pretty's Prints, you agree to the use of required cookies. A cookie is a text file placed on your device by a web server. Cookies cannot run programs or deliver viruses. Cookies are uniquely assigned to you and can be read only by a web server in the domain that issued the cookie.

We may use cookies to collect, store, and track information for statistical, functional, or marketing purposes in order to operate our website. You may accept or decline optional cookies. Certain required cookies are necessary for the website to function and do not require consent. 4. Digital Products and Delivery

Pretty's Prints offers digital artwork, clipart, printables, templates, and related creative resources. Unless a listing expressly states otherwise, products are digital downloads. No physical item is shipped.

After purchase, download access is provided through the applicable sales platform (which may include this website, Etsy, Gumroad, Creative Fabrica, or another authorised channel). It is your responsibility to download and safely store your files. Re-download availability depends on the policies of the platform through which you purchased.

You are responsible for ensuring that you have compatible software, devices, and printing or design tools to use the files.

5. Refunds

Because digital products are delivered instantly and cannot be returned once accessed, all sales of digital goods are final once the download or template link has been accessed. This is consistent with Etsy's digital item policy and with ordinary practice for instant digital delivery.

If a file is corrupted, incomplete, or does not open as described, please contact Pretty's Prints before requesting a chargeback. We will make reasonable efforts to replace a defective file or help you troubleshoot.

Nothing in this section limits any non-waivable rights you may have under applicable consumer protection law.

6. Intellectual Property and Ownership

Unless otherwise stated, Pretty's Prints and/or its licensors own the intellectual property rights in all material on the website and in all original artwork included in our products. All intellectual property rights are reserved.

All original artwork included in a Pretty's Prints product remains the property of Pretty's Prints. Purchasing a product does not transfer copyright ownership of the artwork to the buyer.

Your purchase grants you a non-exclusive licence to use the artwork or template according to the permissions and restrictions in these Terms and in the licence file supplied with the product. You may not sublicense, transfer, or resell the artwork or template itself. You may access material from Pretty's Prints for your own permitted use, subject to the restrictions in these Terms. You must not:

• Copy or republish material from Pretty's Prints except as expressly allowed by your licence;

• Sell, rent, or sub-license original material from Pretty's Prints;

• Reproduce, duplicate, or copy original material from Pretty's Prints except as expressly allowed;

• Redistribute original content or original files from Pretty's Prints.

Certain products may include third-party elements (for example, icons designed by Magnific at Flaticon). Those elements remain subject to their original authors' licences. Pretty's Prints does not claim authorship of such third-party elements.

7. Clipart Commercial Use Licence

This section applies to clipart and illustration products sold or provided by Pretty's Prints under a commercial use licence. Your purchase gives you permission to use those clipart images in your own creative projects and products, subject to the terms below. Please keep the licence file supplied with your download for your records.

7.1 What you may do

Create physical products. You may use the clipart to create physical products for personal or commercial use, including products that you sell. Examples include:

• T-shirts and apparel;

• Stickers;

• Mugs and drinkware;

• Greeting cards;

• Art prints and posters;

• Journals, notebooks, and planners;

• Tumblers and tote bags;

• Home décor, craft projects, and handmade products;

• Other physical products where the clipart is incorporated into your own design.

Create digital products. You may incorporate the clipart into your own digital products for personal or commercial sale. Examples include:

• Digital planners and printables;

• Invitations, worksheets, journals, and templates;

• Digital stationery and educational resources;

• Social media graphics and digital artwork;

• Other original digital designs.

Your finished product must contain your own creative design or layout. The clipart must be used as an element of the finished product, rather than being offered as the clipart itself.

Print-on-demand. You may use the clipart in designs created for print-on-demand products. You are responsible for ensuring that your chosen print-on-demand platform allows the use of third-party artwork and that your finished design complies with that platform's terms.

7.2 What you may not do

Resell the original clipart. You may not sell, redistribute, share, trade, gift, or otherwise provide the original clipart files to another person. This includes:

• Selling individual PNG, SVG, or JPG files;

• Giving the files to friends or customers;

• Uploading the files to file-sharing websites;

• Including the original files in another clipart bundle;

• Selling the files as stock graphics;

• Offering the files as a free download;

• Uploading the files to websites where others can download them.

Your purchase is a licence to use the artwork, not ownership of the original files.

Do not claim the artwork as your own. You may not claim that the original artwork was created by you. You may create your own designs using the clipart, but the underlying Pretty's Prints artwork remains the intellectual property of Pretty's Prints.

Do not use the artwork as a trademark or logo. You may not use Pretty's Prints clipart as a trademark, service mark, business logo, brand logo, or other identifying mark. You also may not use any artwork containing third-party trademarked logos, characters, brands, or other protected intellectual property in a way that suggests you own or have rights to those trademarks.

Do not share your download. Please do not share your purchased files with coworkers, friends, family members, customers, online groups, or other third parties. If another person needs to use the artwork, they should purchase their own licence.

7.3 Finished products versus original files

The simplest way to remember this licence is: create with it; do not redistribute it. You may use Pretty's Prints clipart to create and sell your own finished products. You may not sell or distribute the original clipart files.

Allowed examples include using a Pretty's Prints illustration to create a sticker and sell the sticker; using several illustrations to create a printable journal page and sell the finished PDF; or incorporating the artwork into a T-shirt design and selling the shirt through a print-on-demand service.

Not allowed examples include placing the original PNG files into a ZIP folder and selling them as your own clipart bundle; uploading the original artwork to a website and giving others access to download it; or claiming that you personally created the original Pretty's Prints artwork.

7.4 Your customers

If you sell a physical or digital product containing Pretty's Prints artwork, your customer may purchase your finished product. They may not receive the original Pretty's Prints clipart files as part of that purchase. Please flatten, embed, or otherwise protect the artwork when necessary to prevent the original files from being extracted or redistributed.

8. Personal Use Licence for Templates

This section applies to templates and similar structured products sold or provided by Pretty's Prints under a personal use licence (including certain planners, journals, and workspace templates). The product listing and the licence file included with the download will identify when this licence applies.

8.1 What you may do

• Use the template for your own personal or internal business use, with unlimited duplications within your own workspace;

• Customise, rename, restructure, and modify every part of it to fit your needs;

• Use it for an unlimited number of personal projects.

8.2 What you may not do

• Resell, redistribute, or share this template (in original or modified form) as your own product, whether for free or for payment;

• Upload this template, in whole or in part, to any other marketplace, template library, or file-sharing service;

• Claim authorship of the original template design.

8.3 Platform compatibility

Templates that rely on a third-party platform (for example, Notion or another host application) are provided “as is.” Pretty's Prints may test a template at the time of release, but third-party platforms may change features over time, which could affect template functionality. Pretty's Prints will use reasonable efforts to keep products updated, but cannot guarantee compatibility with future platform changes.

9. User Comments

Parts of this website may offer users an opportunity to post and exchange opinions and information. Pretty's Prints does not filter, edit, publish, or review comments before they appear on the website. Comments do not reflect the views and opinions of Pretty's Prints, its agents, or affiliates. Comments reflect the views of the person who posts them. To the extent permitted by applicable law, Pretty's Prints shall not be liable for comments or for any liability, damages, or expenses caused or suffered as a result of the use, posting, or appearance of comments on this website.

Pretty's Prints reserves the right to monitor all comments and to remove any comments that are inappropriate, offensive, or in breach of these Terms and Conditions.

You warrant and represent that:

• You are entitled to post the comments on our website and have all necessary licences and consents to do so;

• The comments do not invade any intellectual property right, including copyright, patent, or trademark of any third party;

• The comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material, and do not invade privacy; The comments will not be used to solicit or promote business or to present commercial or unlawful activity.

You hereby grant Pretty's Prints a non-exclusive licence to use, reproduce, edit, and authorise others to use, reproduce, and edit any of your comments in any and all forms, formats, or media.

10. Hyperlinking to Our Content

The following organisations may link to our website without prior written approval:

• Government agencies;

• Search engines;

• News organisations;

• Online directory distributors, linking in the same manner as they hyperlink to the websites of other listed businesses; and

• System-wide accredited businesses, except soliciting non-profit organisations, charity shopping malls, and charity fundraising groups, which may not hyperlink to our website.

If you find any link on our website that is offensive for any reason, you may contact us at any time. We will consider requests to remove links, but we are not obligated to do so or to respond to you directly.

We do not warrant that the information on this website is correct, complete, or accurate, nor do we promise that the website will remain available or that the material on the website will be kept up to date.

12. Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our website. You agree to remove all links to our website immediately upon request. We also reserve the right to amend these Terms and Conditions and our linking policy at any time. By continuing to link to our website, you agree to be bound by and to follow these linking terms.

We shall not be held responsible for any content that appears on your website. You agree to protect and defend us against all claims that arise from your website. 16. Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that the courts of British Columbia shall have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have as a consumer in your place of residence.
